Dear All,
Please help me with ESI is applicable for?
it a software company, i have 16 employees whos salary range is more than
15001 as said by ESI guys only 2 guy are below
i must take account is it mandatory...

if you have more thn 20 or 20 employees working with your firm then ESCI is applicable to you.

ESIC Is applicable to the establishment where the total no. of employees is 10 or more than 10 whose salary is below 15k.. reg vikram

You unit is coverable under sec. 2(12) of the ESI Act, i.e. irrespective of the employees wages, if ur unit is engaging 10 or more employees. Please start compliance immediately......

Thanks for your reply ,
Little confused i have total 16 employees, 14 who salary is more that 15 K.
And i have 2 guys with less that 10 K.
we want to go with a medical claim group policy with all
Is ESIC is mandatory to me or ?
again 10 or 20 employees.

Dear Shiv,

As per the ESIC ACT when ten or more employees are working with the aid of Power ( Like in Manufacturing Companies where the production is based on Power) and getting salary less than 15K or when twenty or more employees are working without the aid of Power and getting less than 15K than the ESIC applicable

1. 10 or more with aid of power and getting less than 15 K ( 10 employees must be there with less than 15 K salary)
2. 20 or more without aid of power and getting less than 15K ( 20 employees must be there with less than 15 K salary)

Suppose you have 60 employees and only 5 employees are getting salary less than 15 K than ESIC is not applicable when the number of employees exceed 10 who are getting salary less than 15 K than ESIC applicable , when you get the registration in ESIC , when ESIC code no. has been allotted to you in that case even the number of employees reduce below 10 or 20 who are getting salary less than 15 k even in this case you have to deposit ESIC

Dear Friends
It seems that U R not empowered with the latest amendment in ESI Act. Now the definition of worker/employee has been amended to the effect that all are to be computed for the purpose of Coverage under the Act. However the financial liability for contribution shall be upto 15k. The Employees strength of 10 or more is sufficient for the purpose. Do not incur liability of penalty & prosecution. What Mr Vsyamprasad has opined is 100% correct. Wish u good luck.

Dear Mr Shiva
Your IT company is amenable under the provisions of the ESI Act with effect from 1-6-2010 onwards by virtue of the new amendment made to section 2(12) and sec 2(9) which came into effect from 1-6-2010. In your case you are having 16 persons working out of which only 2 persons are drawing salary below Rs. 15000/- Hence your firm will amenable under the Act by virtue of employing more than 10 persons but you are liable to pay contributions in respect of two employees only who are coverable under section 2(9) of the Act

The opinion expressed by you as above is not correct by virtue of the latest amendment made to section 2(12) of the ESI ACT which came into effect from 1-6-2010. According to the latest amendment, all the persons working in the factory/establishment irrespective of their salary will be counted for the purpose of arriving the figure of 10 or 20 and if once it satisfied the required number of persons, then it is amenable under the Act but you are liable to pay contributions only to those employees who are getting salary of less than Rs. 15000/- per month.
