I need to draft a letter to ESIC organization for surrendering one company's ESIC code after the merger of two companies. Please advise me on whether I should draft a surrender letter or a cancellation letter. One company has taken over another company through the merger, which means I need to surrender one company's code to ESIC. Kindly provide me with an appropriate draft to submit to ESIC Corporation.

Dear Sir,

Kindly review the provisions of Section 93A of the ESI Act, 1948.

There is no system for the cancellation of any code number. However, you can request the closure of the code number from the date of such merger. Please send a request to the appropriate Regional/Sub/Divisional Office of the ESIC, under which your establishment is covered, providing all the details regarding the merger of one unit with another. Ensure them that the compliance for the employees of the merged establishment will continue to be carried out under the ESIC code number of the firm to which the establishment is merged. Therefore, you may request the closure of the specific code number.

Please attach the documents related to the merger, such as the company resolution, change of partnership deed, and the order from the registrar of companies.

Additionally, send copies of the letter to the appropriate Branch Manager of ESIC and Social Security Officer to whom your firms are linked for further necessary actions and information at their level.
