Three months back I went on maternity leave. Before going on Maternity Leave I informed my manager verbally that I can return to office only after 6 months.
Today my manager called me and informed that I need to rejoin back next week, as all my paid and one month unpaid leave has expired. I am in a great trouble, as I dont have a child care arrangement and cant leave my 3 month old child and go for a late night shift job.
I informed my HR that I need to quit, as it is impossible for me to join next week. HR told me very rudely that your company has supported you by giving paid maternity leave, and now you are telling that you are unable to join. You will not get your releiving letter, if you dont serve your 1 month notice period.
I was in the peek of my career when I went into maternity leave. I got a promotion and a hike, as I was the best performer in the appraisal cycle. I worked in this renouned company for 2 years with my full dedication and collected appreciation letters and certificates.
I am not in a position to go to office leaving my young child at home or in a day care. How I will convince them to provide my releiving letter as I am not in a position to return to work after my maternity leave?

As per the maternity Act you can take maximum 3 month paid leave which is 6 week before the delivery & 6 week after the delivery.
so, here your case is totally diffrent, you are saying that you are having family problem, So, you have to give them 1 month notice period.
Otherwise you do one thing you go to office meet your manger personally and share all the problem and request him/her as well as HR.
I'think definitly you will get some solution. If you really not want to work there then you can leave that company. Ifthey will not release you and not giving you the relieving letter, then you have to take different way.
Bcz most of the company's are not doing varification.
