Dear All,
Kindly suggest the way outs if your resignation is not been accepted by the organization and your mails of resignations are not replied by MANAGER/HR/ADMIN/MD etc. What an employee need to do in that case.

I have resigned as i have Family issues and i am currently staying in Mumbai
and my family is in Punjab so have to go there as my family needs me
as if i have not signed any bond also i have resigned 17 days back but still i have go no response on my resignation.
and they are not saying any thing officially i am under stress and very much tensed.
Not getting what to do and what not to.

Dear MK,
I had words with them as they are stating either serve 3 months of notice or go without exp letter.
Please suggest me further processing as i can serve only one month of notice and they also have exit interview policy in which we can buy out for remaining 2 months.
But not getting any outcome.
Please suggest any measure so that i may get relived ASAP.

Dear Mr.Kapil,
The experience thru which you are going is also happened with many more like you.In such cases you have to explain your future employer the status of your relieving.You put all hard copies of the mail,resignation letter with him.Also do one thing on priority basis,post your hard copy of resignation letter by registered post.As per the general practice and on the ground of humanity your present employer should relieve you after one monhts notice and buying rest 2 months.But mu suggestion to you is relieve without exp certificate if offering employer is ready if not convene him about the situation.
In my past company same thing has happened and employee had left without obtaining exp certificate.

Thanks a lot for you suggestions, But i think these days mails are also proof that we have resigned
rest i am already in talks to them but only verbal they are not replying my either of the mail and telling me that "You have to serve your 3 months of notice period and it will get calculated from the day you put your resignation. In case you have to get relieved before 3 months then company reserves the right to stop your experience and relieving letters."
Please suggest that is this legally there sole right to reserve anybody's experience and relieving letter though i buy out and they are also saying buy out is opened if your manger approves and for manger they are instructing not to relive lots of politic going on here though i have stated i have family issue's still they are not co-operating with me.

Dear Kapil,
Kindly throw light on the appointment letter, whether they have mentioned the notice period has 03 months and also, most of the companies would have clearly mentioned in the appointment letter that the buy-in of notice period is mainly based on the discretion of the management, if such a case, the employer have the right to say that to serve for 03 months notice period, if the same has mentioned in the appointment letter.
As per me, better get relieved properly rather than going legally. i hope convince the management the real motto beyond your resignation and convince them to relieve you as soon as possible. its always better to leave the company in the good terms.

Thanks for the advice i am not at all going legally but the thing is i should also get what i have served and regarding 3 month of notice they will not be giving any single penny to me as of there is a clause in there HR policy that the payments will be stopped from the date of resignation till the 90 days from the date of resignation.
And now they are saying i will be relived early but company reserve the rights not to issue relieving & experience letter to me.
How much right it is?
And what can be the next thing requested to them so that i can be relieved ASAP with relieving letter and within one month as i should be also given an option to buy out for the remaining 2 months which i don't want to serve due to Personal/Family issue's.

Here are few action point for you-
1. send a copy of your resignation to your personal email. Also copy your personal email id in every communication related to your resignation and NP discussion.
2. send another email mentioning that you can serve only one monthe NP and remaining you will buy.
3. if they do not say anything...just stop going to office after 30 days. They can not abscond you as you would have already resigned. They will have to relieve you and give other documents as well because legally you would not be at fault.
