We are a sheet metal fabrication unit with press machines predominantly in Pune, Maharashtra. It is unclear if our organization falls under the Factory Act or the Engineering Industry.

1) Could someone please help me clarify the difference between the two?

2) Could this be established by some authority, stating which industry I belong to, to ensure that I am compliant with the law?

You have started in the Engineering Industry, and once you continuously engage 10 or more workmen with the aid of power for 240 days, you will be covered under the Factories Act. The Factories Act prescribes and regularizes the plant, machinery layout, safety, and welfare provisions. For wages, you are governed by the minimum wages payable for the Engineering/Fabrication industry. The Engineering Industry is one category of industries under the Factories Act.

Thank you, Mr. Babu. Just to clarify, I would like to know if I fall under Residuary under Factory Act, 1948, or Engineering Industry. In the following link https://www.citehr.com/485436-differ...t-1948-a.html: it mentions that erection and assembling of equipment like automobiles, transformers using scientific technology fall under Engineering. Do press machine operations also qualify for the same?

Right fabrication unit with press machines... undoubtedly, yours is a factory. And now, the factory definition is widened - it covers even a petrol bunk as a factory. So why not yours? The engineering industry is nothing but all engineering works, surely done by machines. Every factory should have machines for producing new useful products. Your establishment is a factory producing metal sheets by pressing machines. Whether it involves repairs or vehicle washing units that have machines and some manual engineering works, all come under a factory. So, go ahead with labor laws and other departmental laws of the factory. All the best... undoubtedly.

Small correction: The Maharashtra Factories (Amendments) Act 2015, also known as the Factory Act, is applicable in Maharashtra. If the manufacturing process is carried out with the help of 20 or more workmen with the aid of power or 40 workmen without the aid of power, respectively.

Every state has some minor amendments, but the concept behind the Factories Act is applicable to all such factories. All scientific process industries, including bio-products and Ayurvedic health-producing units, natural face cream manufacturing units, and pickles manufacturing units, also come under the Factories Act definition either with a number of workers or with M1, M2 types of categories of using the quantity of electrical energy. (Please search in Google for more information on the Factories Act).

Factory and Engineering unit difference... no difference... All factories have engineering works. So, all engineering working units are undoubtedly factories.

Your version defends that we have lathe welding and press machines, and we are working with our hands, like handicrafts, and allied works of a factory. For example, assisting units manufacturing some bolts, casting works, etc. In the case of a car factory, not all parts can be manufactured on its own premises. Its allied units of engineering works have made many parts that are comfortably satisfied and used by the car company. I think not everything can be written here... it may be understood.

Sir, I feel that this forum is not meant for learning the basics of labor acts. I feel that here, there are extraordinary genius members who lift the blocks and safeguard workers' rights and encourage good HR practices and employers to avoid struggles with workers. Only when an employee, HR, or employer should take steps in implementing labor laws, then if they encounter any difficulty, forum members can coordinate in finding the right way.

What I feel is that people with queries should do some homework on labor laws, like searching on Google or reading and following the names of labor laws. Implement it, talk with your company lawyer, and then ask for clarification. That's the right way of using this forum.

If not, people message me asking, "What is the minimum wage?" I am surprised that a HR person from a big company is asking such a question. If you don't know, try searching on Google or referring to any labor manual on the Minimum Wage Act. Forgive me if I am wrong. Please.
