We are manufactures of chokes and transformers. My question is whether we fall in Engineering category or residuary category under minimum wages act. Kindly help .

Pl check with the labor office of your state whether the have fixed MW for employments in Electrical equipments,or Electronics ,If so that will be applicable for you.If not get a clarification from labor office.

Ashwin will not get answer from labour department in maharashtra. officers in maharashtra lobour department have no concern of law enforcement but they are concern with GANDHI BAPU.

Dear Ashwin ji,
Manufacturing of electrical equipments or electronic items is not a schedule industry under the MMW Rules 1948. Therefore your manufacturing unit will fall under residuary.
What I believe is you are in manufacturing and not in Engineering i.e. not in designing, building, maintaining any structure, machine, device etc. by applying scientific technology.
If you are in Electronic Exports Processing Zone then you are in schedule industry of SEEPZ.

Dear Ashwin ji, To add further, if you are in installation / erection or commissioning of transformers, then to you Engineering rates will be applicable.

I think the rates for engineering industry will apply to any unit that is making machines of some type.
But this does not hold true.
For example, all automobile companies pay for engineering company rates, not for manufacturing rates.
Unfortunately, there is no definition provided, so it depends on how you wish to interpret it (and how the same is looked up on by the labour officer).
In general, it is better to take the higher rate (the difference being small) to avoid any controversy.
