Please let me know what is the procedure or law for availing maternity leave second time. Also please let me know the law section and subsection as a documentary proof to present in front of my management. Thanks in advance.

What exactly is the nature of your query? Have you read the provisions of Maternity Benefit Act, 1961? Is this query for yourself or some woman employee of your company? For how many years, woman employee is working with you? Did she avail of maternity leave earlier during her tenure in your company?

If woman employee is pregnant for the second time then obviously she is eligible for the maternity leave for the second time. As far as proof pregnancy is concerned, you may tell her to provide the gynaecologist's certificate. If the woman employee is covered under ESI, then she can bring the certificate from ESI doctor. For availing of the maternity leave for the first time, what certificate she had provided?

Dear friend, you have raised this query, nevertheless, if you are from HR, and if your query is for some woman employee of your company, then it has connotation of some suspicion towards her. Suspiciousness erodes employee motivation. Therefore, do not take legal provisions with the pinch of salt.
