Dear All,
I have joined a Pharmaceutical Company 1 month ago. This company is established in April 2018 & its LLP(division of 1 of the group of companies), having strength of 24 people including Medical Representatives & others. Medical Representatives are 20 Nos. We have office only in Mumbai & MRs are working from their current location(where they stay) out of Mumbai. They operate from home. Now we want to take a Shop & Establishment Certificate. I wanted to know how many employees should I mention on the Certificate. Because as we are more than 20 we are applying for PF & ESIC as well. Also PT was deducted last month.
Please reply ASAP.

Shop and establishment license is no longer required in mumbai for any office with less than 10 employees (however I don’t have the notification copy). So if you have only 4 employees in the office you don’t need a certificate
You should also not be deducting professional tax in Maharashtra for employees who are not in the state of Maharashtra. You are instead liable to pay it in the relevant state. Practically however it’s difficult to register for PT in a state where you do not have an office. In any case there is no PT liability in Maharashtra for any person not working in the state
