Dear Seniors,

We are in the construction business, so do minimum wages for shop and establishment apply to us? We are a group of companies with 8 companies currently, and we have distributed employees among them. None of the companies has 20 employees. Do we fall under the Gratuity Act? Are we subject to the PF and ESIC Acts?

We also operate a trust. In our trust, we have more than 28 employees. Do we come under the PF and ESIC Acts? Our trust primarily focuses on serving community children by providing scholarship assistance. Additionally, we offer scholarships to students outside the community and support women empowerment initiatives.

My question is, does our trust come under the PF, ESIC, Gratuity Act, and minimum wages act?

Dear SAWANT,

Your construction activity will come under the purview of the minimum wages if fixed by the Appropriate Government for employment in the construction industry. Regarding the second query, whether the 'Trust' is registered under the Trusts Act or the Societies Registration Act? My personal view is that all the appropriate Labour Laws would be applicable to it.
