Hi
Can anyone guide me the Earned leave,Sick Leave(if applicable as per the Act) and Casual leave (if applicable as per the Act) to be availed as per The Shop and Establishment Act,
I am aware that factory Act mentions that for every 20 working days 1 earned leave is to be availed but according to Shop and establishment I think it is different
Please help me to know abt PL SL and CL

Dear Reshma,
According to Shop & establishment, Rules for Leave in a year are :
EL : 15 Days
CL & SL : 12 Days
there is no byfurcation in CL & SL,u can treat it as u want.

    1. what is the base of calculating 15 PL
    eg: for how many working days 1 PL is proportionate
    2.Question is Same for SL and CL as well
    3.What is the encashment clause i e limit of carrying forward
    4.Also which amongst 3 gets lapse
    5.ESIC gives benefit in sickness is it so that SL is availed for only those employees who are not covered by ESIC

    I have newly joined a KPO and that comes under Shop and Establishment Act. I am not aware about this act and does not having any kind of experience. We are hiering people not on roll but as a consultant @ Rs. 250/- per hour. Do we need to bound to pay ESI/PF to them??

    in my view they are not your employee and they are professional,so you are not required to deduct PF or ESI but same movement u have to deduct TDS whcih is about 10% for professionals which very high.suppose some one is getting 10000 per month in that case u have to deduct1000 as tax.

  • As per the standard A.P SHOPS N ESTABLISHMENT ACT LEAVE PROCEDURES ARE:-
    PL :- 15 PER YEAR ,IT can be availed as per 1.25 per month on evry month or can avail till one year ,clause is Associate should complete 1 year of service,means after confirmation.
    CL :- sTANDARD 12 can avail 03 at a time n monthly once.
    SL :- AS PER Company norms n as per mnc we offer 12 per year that too as per the emergency it cannot be carry forwarded will lapse at the end of the year.as CL
    pl can accumyulate till 60 days then again starts from 1
    8 u can encash n 07 u can avail in the year n month of october as per company norms.
