Dear All,
I was an off role employee in a reputed LTD organization and i left the organization after immediate effect of resignation mail without the notice period but the verbal intimation is given to circle team.The resignation is not accepted by our Regional Head.
I am trying to get the clearance of my F&F, Experience & Relieving letter but they put these things on hold since 3 months.
Please suggest me a path to get clearance.

Dear Shashi,
Do you agree / accept if you have been terminated by the company on the same day.
Normally for an absconding employee or for employee who does not serve the notice period the company don't give the Relieving letter or experience letter. Check your company policy for the same.
What is your notice period clause. If it is 1 month or 3 months. The company has the right to claim the dues from you and give your F & F settlement balance or recover the amount from you.

Dear Shashi,
Every company has its process & policies in place. This is a universal truth that any employee who does not serve a proper notice will NOT receive exp & rel letter nor will he be eligible for F'n'F even when he is an off role employee.
The only way out is to either complete your notice term or pay salary in lieu of notice period. But to accept the notice pay or not is completely at Company's discretion. It might happen that they insist on serving the notice period if your position is critical.
You have not mention the reason for such misconduct, but pl understand that notice period is a time which company buys for hiring a replacement & for you to handover the tasks assigned.
Check with your hiring manager &/or reporting head.

If you are an Off role employee, then you must take the experience letter, relieving letter, F&F Settlement only through your service provider. If you have not fulfilled the employment terms and conditions then you cannot expect the other to fulfill your requirement.
Hope you might have attended the exit interview, in which they might have informed you about the non acceptance of your resignation letter. Why did you not try to convince the Regional Head about your necessity of resignation and made it positive.
Please send a letter to your ex employer to issue a clearance / relieving letter and Full & Final Settlement and you can even give an instruction to deduct the notice period buy back amount and any other dues to company from your F&F Settlement.

Dear sir,
I have worked for one company more 4 years sales departments and i asper company rule I served one month notice period also.And I have almost 52 EL and 15 days of working days of my salary and almost 20 months my convenience also pending from the employer.And even 4 months completed from last working day with previous... Even this my company not releaving my Full and Final amount.. and every time when I ask to my employer abt my F&F they are telling me that pending dues are there from the market and once it collected they realise my amount .. please help me out or suggest me get my amount.

Please speak to your Boss / HR and understand that what they now requires to relieve you. Most likely, they may ask you to deposit basic pay for the duration of your notice period (in most cases one month only ) and settle your dues. Also talk to them and try to pacify the issues that they have. you may also check the possibilities to adjust your balance leaves in your notice period and settle . In short, take mid path.
If you desire to show the experience in your resume for future employment then its mandate that you get relieving letter from your last employer. Its important for your career not them, pls. make a note of it.
