Dear All, Good Afternoon. :) Please advice, an employee's last working month was April 2019, on May 1st 2019 the employee applied for ESI leave for 3 months. after the ESI leave the employee decided to resign. so what is the date of resignation?? April 30 2019 or 31st July 2019?

What's the kind of "ESI' leave for 3 months at a stretch, is't Maternity Leave or any other sickness? Who paid the leave pay, ESIC? How about the 'Notice Period'. How are you going to deal this Notice period not served??

As Mr. Kumar mentioned if the leave is authorized by ESIC and paid by ESIC then the date of resignation will be 31st July, but you have to ensure that the Notice Period is served or Notice Pay recovered as per the Employment terms

When the Employee has been paid till 31st July 2019, his/her last working date will be July 31, 2019.

Dear All, Please advice, an employee's last working day was 31 March 2019 and taken maternity leave for 6 months after maternity leave employee has taken leave for 4 months and later employee gave resignation on June 30, 2020. What will be the last day to be shown at ESI portal.

Hi Barath,
1.4.2019 to 30.9.2019 - Maternity leave of 6 months (or 26 weeks) and followed by 4 months extension of SL/EL i.e. Oct.19 to 31.1.2020. If it is to be so what happened the period from 1.2.20 till 30.6.20, LWP ?? or absent?

Please confirm the following
1) Employee Last attended on Work was March 31, 2019
2) The Maternity Leave expired on Sept 30, 2019
3) She has extended leave for 4 months was it on medical grounds or it was LWP, please advise
4) The Extended leave expired as per post falls tentatively Jan 31, 2020.
5) She resigned on June 30, 2020. During the leave expiry and resignation there is a gap of 5 months.
6) When was the last ESI paid of the said employee is it Sept 2019, or Jan 2020.
By answering these question I hope your query will be resolved automatically. In nutshell she has not joined any other company till June 30,2020 hence you can put the said date as her last day in ESI portal
