Thanks a lot for explaining the concept so nicely. My friend was not given any F&F letter, nor the releaving letter too. But one important point which is coming here is that after my friend has left the company, many other people had also changed, but there F&F is given in a day (even when other employees has not given notice period). Any notice is not given to any of those previous employees.
Is any settlement possible?

Like also mentioned by Saswatabanerjee every case has its own peculiarity. You cannot compare nor do you have any concern with company's action with other employees. In that case Yash, you can ask him to have a word with the company HR / Competent authority. But as your friend neither has NDC nor has F'n'F settlement statement it is difficult to slip smooth. He'll have to pay the same to avoid legal consequences as the company seems to be adamant on going legal. Also, this might create problem in his current job. Rather than wasting time it is advisable to immediately have word with the employer & clear the catch.

That company has also not paid his bonus for the duration my friend workd there. about 15 months yrs bonus is also with the company.

And I appologize for the mistake,, that I have mentioned your name somewhere else. I had also advised my friend, not to waste time and contact that company at earliest, and try to close this matter as soon as possible, since 31-Dec-12 is the deadline for paying penalty.

Since his salary is above 10,000 per month, he is not eligible for bonus. So that is also not something he can claim a settlement of.

Answer : The company will not issue any clearance certificate to employee and if already issued then NO BODY CAN DO ANY HARM TO EMPLOYEE.
2. What legal actions can be taken against that employee?
Answer : Employer can take legal action against employee if that is in employment terms and conditions and signed by both parties.
3. How much will be the impact of all this on the career?
Answer : Without clearance letters and final settlements employee may not join good professional company.
