Dear Seniors,

We have to release gratuity for an employee who has been working with us at the Gurgaon location for the last 6 years. Please advise on how and where to submit Form-L (Notice for Payment of Gratuity) to the controlling authority in Haryana. Is it possible to deposit online? It would be helpful if you could share the address for submission.

The controlling authority need not be informed of each payment of gratuity, even though Form L mentions a copy to the controlling authority. The controlling authority only comes into the picture when the employer fails to pay gratuity, and the employee seeks the authority's help to receive the gratuity. Form L serves as a communication to the employee to come and collect the gratuity. If the employee allows you to remit the amount directly to their bank account, you may do so. However, before proceeding, ensure that the employee acknowledges Form L to avoid any future disputes regarding the amount of gratuity, computation, or length of service.

Dear Sir,

Thank you so much for your prompt reply and kind advice. Till now, we have been paying all eligible employees under the Gratuity Act by NEFT directly into their bank account within 30 days with full and final settlement and also receive acknowledgment. However, our auditors have informed us to submit Form-L to the controlling authority as per compliance.

It is because the rules state that a copy is to be sent to the Controlling Authority. Also, there are no annual returns to be submitted to any appropriate authority. However, there are a lot of such instructions that we can bypass. Therefore, nobody cares to inform the Controlling Authority whenever payment is made. If the auditors say so, you can start sending Form L to the Controlling Authorities. I would say that not sending it would be a serious non-compliance, but it could only be noted as an observation by the auditors.
