Dear Members,

I worked in a reputed security company for 15 years and resigned as a security officer in April 2018. My full and final settlement was completed that year. However, my bonus for the year 2017-18 has still not been given. I approached the HR Department, and they collected my full and final settlement copies along with the bank account details in December 2018. This information was shared with them two more times to settle my bonus amount. I have personally visited the office nearly 15 times, but the HR Executive is not cooperating and is behaving unprofessionally.

Kindly guide me on how I can resolve this issue and receive my overdue bonus.

Dear Punchbala,

You may file a claim under Section 21 of the Payment of Bonus Act, 1965 before the Competent Authority appointed by the appropriate Government for the purpose of recovery of bonus. Alternatively, you can raise an industrial dispute under Section 22 of the same Act before the area Conciliation Officer as per the Industrial Disputes Act, 1947 for the recovery of the bonus that is due and has not been paid by the former employer.

Dear Sir,

Kindly file the complaint with the Office of the Security Guard Board for Brihan Mumbai & Thane District, D-301, E-301, Sanpada Rly Station Complex, Sanpada, Navi Mumbai 705. Phone number: 022-27751385, Fax: 022-27751387. Copy endorsed to Deputy Secretary (Labour) to the Government of Maharashtra, Industries, Energy, and Labour Department, Mantralaya, Mumbai 400 032, who has granted an exemption under Sec 23 of the Maharashtra Private Security Guards (Regulation of Employment & Welfare Act) Act, 1981, and Scheme 2002 to XXX Security.

The procedure given by Uma Sir will take time. Here, the government and Security Guard Board may cancel their exemption upon receipt of the complaint.

Hi Mr. Srinivasa,

Just for your information, XXX is a licensed company under the Government of Karnataka and is bound by all the rules and regulations under labor law. I was an employee for nearly 15 years and received a yearly bonus. However, after my resignation, my 9-month bonus has not been given, whereas my colleagues who resigned at the same time as me have received their bonuses.

Dear Punchbala, Hope your Basic & D.A. was less than Rs.21,000/- p.m. during the F.Y. 2017-18. If yes, then you can proceed further as rightly advised by the seniors. Tnx & Regds, Suresh
