i am working in a fixed date daily Health Service provider Company under PPP mode.My Duty hours starts from 7 AM and ends at 7 PM.I used to get buffer day in which i have to stay in the office from 7AM to 7 PM.according to the rooster of the company i have to work 26days in a Month(12 hour daily).is it legitimate according to the Labour Law(INDIAN),Please Specify It.

firstly, Incase if we work for 9 hrs in a day and get 2 days weekly off ie. sat & sun, so are we liable for overtime if called on our weekly off??
secondly, what if the company decides to work for 10 hrs/day?? I work in a BPO.
Urgently require ur suggestions.

i have joined in a facility management company they provide housekeeping,pest control, security to various clients (i.e. factories,hospitals,hotels,mnc,retail outlets etc..) do we follow all the Acts saperatly are else for these kind of services do we have any new Act. pls let me know iam totally confused.

Hi,

Working hours for adult workers as stipulated under Factories Act, 1948 are as under:

DAILY HOURS

No worker shall be required or allowed to work in factory for more than nine hours in any day u/s 54

The total number of hours of work in any day shall not exceed ten subject to exemption u/s 64 of Factories Act, 1948

The total number of hours of work in any day shall not exceed twelve subject to exemption u/s 65 of Factories Act, 1948

WEEKLY HOURS

No adult worker shall be required or allowed to work in a factory for more than forty eight hours in any week u/s 51 of Factories Act, 1948

The total number of hours of work in a week, including overtime, shall not exceed sixty u/s 64 and 65 of Factories Act, 1948

WEEKLY HOLIDAY

No adult worker shall be required or allowed to work in a factory on the first day of the week unless-

(a) he has or will have a holiday for a whole day on one of three days immediately before or after the said day.

(b) the manager of the factory has, before the said day or the substituted day uner clause(a), whichever is earlier.-

(i) delivered a notice at the office of inspector of his intention to require the worker to work on the said day a of the day which is to be substituted, and

(ii) displayed a notice to that effect in the factory;

Provided that no substitution shall be made which will result in any worker working for more that ten days consecutively without a holiday for a whole day.

Example: ordinarily weekly off falls on or fixed as sunday in non -continuous working factories but manager can substitute for sunday any of three days preceding or following it, subject to the condition that there must not be more than 10 days continuous work.
