Can workers sleep during duty hours after achieving the production target as fixed with the union, or should they be told to leave the factory? If they leave, should the duty hours be deducted?

Kindly clarify via email at my ID - ramesh.gujre@technocraftgroup.com.

Dear Ramesh,

Notwithstanding the completion of the targets, theoretically speaking, no worker can sleep while on night duty. If he has completed the work assigned to him, then he should assist someone else or be given another task. By the way, what were the supervisor and the production manager doing when the worker slept? Why was some alternate work not assigned to him?

Anyway, this is the internal matter of your company. We, the members of this forum, are outsiders and cannot provide a solution. This is because we do not know how active the labor union is and what the mindset of the union leader is. Is he a troublemaker? Please think it over and choose the right option.

Thanks,

Sleeping on duty is an act of serious misconduct punishable under the applicable Certified Standing Orders and/or the Service Rules. Besides being an act unworthy of employment, such sleeping on duty is fraught with grave dangers, namely accidents, injuries, and attendant repercussions. The employer must be and remain vigilant and stop such acts. Often, few caught sleeping on duty take a defense, saying that he/she was feeling unwell. In such a situation, the employer/duty supervisor must arrange for a medical examination and care for such an individual. Appeasement policy/stand never pays off. Make people aware through regular workshop short sessions.

Workplace is not the place for sleeping. It's the duty of line supervisors and managers to ensure discipline on the work floor. However, based on a few observed cases, at night, after certain hours of work, the production is stopped for a specific rest period to avoid accidents and incidents. In these instances, employees are found in the resting area instead of the workplace or production floor.

Dear Ramesh,

Can workers sleep during duty hours? The affirmative answer is 'No'. Sleeping during duty hours is considered misconduct.

What is the duration of sleeping per shift? This should not be considered as sleeping but rather as rest, as they have completed their job quota for that shift and have no further tasks to perform. You cannot penalize them as they have fulfilled their attendance and met the production target. This is a serious situation because proper time and motion studies were not conducted before setting the production target with the Union.

The only solution is to address this issue with the union to prevent this misconduct. Mobilizing the union to engage workers for extra production with incentives would be a better solution. However, your actions may lead to unrest.

Kindly review and address this matter promptly.

Thank you.

Many employers provide official mobile phones to their employees for performing their official duties, which can also be used for personal matters. However, some sensitive units ban mobile phones, pen drives/CDs, and other copying devices inside their premises. Additionally, such units do not provide freely usable Wi-Fi or internet applications except for their official networking. Therefore, clarification to your query can be both YES and NO, as the decision is taken depending on the sensitive nature of their operations/business.
