I’m working in a very small University. I have sent my resignation letter to my reporting manager on 2nd Aug, 14. Stating my notice period to be of 1 week & will be buying out the rest of the period. However, I was not given any receiving nor any acceptance of the same. My 2 months’ salary has been put on hold, ie July & Aug.

There is no email system, so I had to give the letter in hard copy.

Since then I have been following up with the management for the acceptance of my resignation, & relieving orders.

However, today on 28th Aug, 14 Registrar calls me and tells me that I will not be getting my 2 months’ salary in lieu of my notice period.

Now I’m not having my resignation acceptance, relieving letter, nor my salary.

Now my question is that I have almost completed my 1 month notice, so I shall be getting my one month salary (for July). Am I wrong in thinking that?

If the employer refuses to give my salary & the relieving letter, what options do I have? (Legal system will the last option)

Question is are these small companies so powerful in our country that they can ruin someone’s career for their internal miscommunication?

Please confirm how many days Notice Period mentioned in your appointment letter.

As per the offer letter one has to give 2 months' notice or 2 months' full salary.

Dear Ashish,

Termination of service either by way of resignation or discharge is not one but is two way matter. As a matter of fact the acceptance of resignation needs the consent and approval of the management. As you indicated that as per the offer of your appointment you are required to tender two month notice or pay in lieu thereof. Once you intended to resign from the university you should have checked up with them whether they would accept notice part by pay and part by pay in lieu thereof. Most of the employers do not accept this combination. Having checked as above acceptance of your resignation would have been a smooth affair.

Now please indicate whether you served them for two months and have been denied your salary for the same or what? In case your salary has been denied to meet your obligation towards tendering 02 months' notice and that you ceased to work with them on your own under the presumption that they should accept your contention of accepting one week notice and you will buy the rest of the notice period,the management is justified in its approach.

In case you have worked and denied salary in lieu of the prescribed notice, please approach them in person and explain having complied with the rules and ask for the pay for the period you have worked.

Instead of making communications in writing it is advisable for you to meet the registrar in person and have one to one interaction as acceptance of resignation is dependent on the nature of relationship you maintain with your management (to be practical).

Problem is that we have not got our salaries for July & Aug, and i'm anyways not expecting it.
Secondly, there is no objection from the employer in part buy out option.
Thirdly, Currently from last 2 weeks i have almost no assignment in my bucket. all handover has been done.

Dear Ashish,
Do you continue to be on the rolls of the company, you are resigning?if so, please have one to one discussion for release of pay of two months which you have served them.

I tried that but was refused... with shouting & scolding Is it that employee is totally at the mercy of the employer, and cannot be treated as human?
