Hi, My name is Anupam an Ex-employee of Cognizant, I had a discussion with the management on the 25th of May that I can no longer proceed with my duties for cognizant after 30th as I will be joining another organization on the 31st of May. On the 30th I rolled out the resignation with the same information. I received an instant reply from HR that BU is not considering the Buy out.

Suddenly on the 1st they were ready to consider the Buy out and gave me the last working day on the 3rd of June thought I was not working for them at that time they still considered it as my last working day, as per the HR the last working day cannot be changed as I never had the discussion with management. However, In the emails as well as the discussion I have with the management I specifically mentioned that I will no longer work post 30th.

What should I do in order to seek help?

I gave an instant resignation to buy out the notice notice that I will not be able to work post 30th of May and asked to consider my last working day as 28th of May in the resignation

On 25th I had a discussion with the management that I will not be able to work prior 30th.

The organisation Approved the notice buy out however, they assigned the lst working day as 3rd of June.

I already joined another organisation on the 31st of May which could have an impact on the dual employment.

What can I do as the previous organisation is not replying on my emails moreover, the current one is not changing the joining date.

I still don’t know what the problem is. So what happens if they don’t change the dates? And you have left without notice, why will the company bother to cooperate with you?

I want my last working day to be changed to a previous date, this is the issues.
I left without notice thought they agreed with me and offered me to buy out that notice, I am ready to pay them on behalf of the notice.
Now I want to know weather they will change the last working day or should I proceed legally.

Let me correct myself I didn’t left without the notice I asked them to provide me to buy out the notice period but I stopped working for them after 28th.
I sent a resignation email on 30th to consider 28th as my last working day, they approved all of this which took 3 days. They considered 3rd as my lst working day but I want it to be 28 as that was the last day I worked there.

I joined my new org on 31st.
Now I want them to issue me a releasing letter for 28th not the 3rd.

The above makes it very clear that you left without notice. You told them 5 days before you left that you will not work any more. your resignation was on your last working day. So, irrespective of what you pretend, you left without notice.

They agreed later to consider a buyout? Probably someone thought that they may as well get some of their cost back since going a legal notice is ineffective. Why will they help you? I definitely wouldn't.

Anyway, you have no option but to try and sort it out. Probably a personal visit to the previous office may help. Since we don't know the people concerned, I can't comment on its effectiveness. If they are not replying to your email (and you have not paid the buyout), probably they are not concerned or want to punish you for your behaviour.

Incidentally, if your current employer has no problem with your 'Dual Employment', why are you worried about it?
But in any case, you have no recourse as such. Going the 'legal way' is completely ineffective.

The solution is joint declaration letter(Form) available from EPFO office/site signed by you and Cognizant and deposit it to EPFO. If your present organization has not deposited your PF, the alternate method may be to set your date of joining after your releasing date from Cognizant. But if it is already done by your new organization, then only the first method is the option.
