I worked in an organization where I had some dispute with the company. They asked me to resign, and after discussion, they asked me to resign on the 19th of June. The company agreed to give me my salary till the 31st of August. They had given me acceptance on the company letterhead and mentioned that my resignation had been accepted, and they were relieving me immediately. Kindly suggest if they accepted my resignation and relieved me immediately, then I should get my payout after the handover or 45 days from the last working day. When I went for the handover, they told me that they would give me salary on a monthly basis, and the full and final settlement would come after 45 days from the 31st of August.
I asked them to give me an accepted resignation mentioning the last working day as the 31st of August. However, they refused to give acceptance even via mail. As per law, can I insist on being sent an email? Now they are saying that on the final experience/relieving letter, they will mention the 31st of August as the last day. So, if I give it to my new employer, then as per the first acceptance which they had given, my last working day and relieving date were the 19th of June. But as per the experience/relieving letter, the last day is the 31st of August. Can I ask for an accepted resignation mentioning the 31st of August as my last working day? HR told me that the relieving date and the last working day can be different. Is it so? Kindly guide.

45 days salary is notice payout last working day is the date when you appeared on the establishment for work purpose or handover day
My question is different.
1. Can I insist the company to provide acceptance of resignation via email?
2. Can the relieving date be different from the last working day in the case of a holiday on the last day? I can understand that, but my scenario is different.

Dear Colleague,
The last day is mentioned or required to be mentioned in the relieving letter. In your case, since they have agreed to 31st Aug as the last working day, you should insist on them to include it in the relieving letter before you complete your handover formalities.
