Can anybody help me out with format of Appointment Letter to a Consultant (Freelancer).
Is it necessary to have an agreement signed between the 2 parties?? Or we can have a normal appointment letter for the same.
Also, is there any legal formalities to be taken care off, when Consultant quits or organisation terminates him??

We are pleased to appoint you as a Consultant on a retainer basis in our organization under the following terms and conditions:
1. Your consultancy period shall be for twenty-four months, commencing on 13th November 2007, with the possibility of extension or early termination upon a two-month notice from either party, without providing a reason.
2. You will receive a certain percentage (which may vary based on the project) of the Project Cost upon successful deployment with the client.
3. Your primary place of work will be at __________, but you may be required to relocate to serve any of the Company's Projects or establishments in India or abroad at the Management's discretion.
4. This appointment and your engagement as a consultant are contingent upon your medical fitness as determined by an authorized Medical Practitioner.
5. Unless prior written permission is obtained from the Company, you are prohibited from publishing articles, delivering lectures, or making any communications to the press regarding the Company's products or any related matters.
6. You are expected to maintain strict confidentiality regarding Project documents, commercial offers, design documents, Project cost estimates, technology, software licenses, company policies, trademarks, and employee profiles.
7. Compliance with all Company rules and regulations is mandatory.
8. Any confidential information acquired during your assignment must not be disclosed even after its conclusion.
9. The Company reserves the right to terminate your services without notice if you are found to be non-performing or engage in fraudulent, dishonest, disorderly, or negligent behavior, among other violations outlined in this letter.
10. Accepting gifts, commissions, or any form of gratification from parties dealing with the Company is strictly prohibited.
11. You are responsible for the safekeeping and proper return of any Company property under your care.
If you agree to the above terms and conditions, please sign the declaration provided and return the duplicate to us. The original copy will be kept by you.
