Dear Seniors
My organization comes under shops & Establishment act. And a few days back a Labor Inspector comes and asking for the Standing orders certified from the Labor Department. As I do not know much about it because as far as my knowledge after the starting of the any organization, in next six months the company has to make the Standing order and get it certified. But the org. is running from last three years and it’s not having any standing order till now. And I have joined this a few months back so I am not having the clear idea about it.

This is a hotel where we have our own corporate office but they told me to make it by urself for your unit. I request you all to please give me some idea how to go about for this.

Please seniors help me…………

Dear DSP, Till the time Standing Order is not Certified by LC, then the model standing order is applicable , u dont have to be get it certified if there is no union of workers AGP

You are from which state??? In Maharashtra, an establishment having more than 100 employees has to certify its standing orders by the Deputy Labour Commissioner. Please check with your nearest labour office for the same.

In Maharashtra whose consent will be taken for hearing as second party, no matter how much strength u have for the perpose of Certified standing order AGP

Thank you, seniors, for your help and support. We have more than a hundred employees, and I have consulted with the labor consultant who is assisting me in consolidating and certifying it with the labor department. Once I have completed it according to the provided guidelines, I will definitely share it with everyone to avoid any confusion, similar to what I experienced.

Dear Patil,

Please do not give wrong advice. It has to be certified if the strength is more than 100. If the union is not there, then an inspector will visit your establishment to elect a workers' representative for this purpose.

Your company in Gujarat has over 2500 employees who work as sales promotion employees throughout the country. I have a question: Can the company transfer any sales promotion employee from one state to another without any certified standing order? The issue is currently in the labor court, as the company has not provided any certified standing order in writing as required by the labor department.
