I worked in a CMM 3 level IT company for 2 years and then I sent my resignation through email since I got a good offer in another company. As per my offer letter, the notice period is 90 days. During my notice period, I sent several emails regarding my resignation, but HR did not accept or reply to them. When I asked orally, HR mentioned they would inform me after the completion of 90 days. Therefore, I waited until the 80th day to inquire about my relieving process. As my 90th day approached, I asked HR about my relieving date, and they suddenly informed me that they could not release me until my current projects were completed. I reminded them that I had completed my 90-day notice period as per the offer letter and requested to be relieved.
After the 90th day, HR started to pressure me, stating that if I did not finish my ongoing projects, they would not provide me with a formal relieving letter. Feeling stressed and frustrated, I continued working on my project and sent reminders about my resignation, but I received no response from HR. Eventually, when I inquired about my relieving letter, HR informed me they could not provide it and suggested I leave without it; they even blocked my access card.
Despite serving a total of 170 days (90-day notice period + 80 extra days), I did not receive the relieving letter. Throughout my notice period and the extra days, HR, project managers, and management treated me poorly, forcing me to work and making threats. This situation caused me to lose other good job opportunities.
I have always worked sincerely for the organization and have communicated my resignation multiple times through emails to HR, project managers, and the management. I also have threatening emails from HR.
Following my 90th day, I engaged in discussions with HR, project managers, delivery managers, and the management, but they refused to accept my resignation.
I seek advice on how to obtain my relieving letter from the organization promptly, as this document is crucial for my future career. If I choose to take legal action against the company, how long would the legal process typically take?
In the meantime, please advise on any other possible ways to obtain the relieving letter promptly.
