Hi,

I work in a small domestic IT company. My appointment letter states a notice period of 30 days. I am currently serving the notice period and working on assigned tasks. However, now they are asking me to sign a new contract that states there will be a notice period of 60 days. I want to know if I am obliged to sign this document. Secondly, if I don't sign it, what consequences could there be? Additionally, I would like to know if they can halt my relieving process after the completion of my notice period.

Logically speaking you are already on notice period,why company should ask you to sign a document which says 60 days.Meet HR and decline to sign such documents.

Dear Friend,

As informed by Mr. Rao, you need not sign a new contract that stipulates a notice period of 60 days. Since you are serving a notice period of 30 days, which should be completed by the 30th day from the date of giving notice to management, you can inform the HR department that you should be relieved from the services of your present employer with full and final settlement on the lapse of the 30th day.

If they insist that you sign a new contract, you will be in trouble, and in such a case, you will need to complete a 60-day notice period. The management cannot arbitrarily alter the service conditions mentioned in your original appointment letter without your consent, and as such, it is not legally valid at all.
