Hi,
My notice period is 60 days. I need to join another organization within 30 days. In my current they are not allowing me to go without serving notice period. i.e 60 days. And telling that relieving letter will not be given if i leave within notice period.
My question is is there any law so that i can get my relieving letter?
As per my knowledge, if i leave after 30 days, they should give my relieving letter and experience letter after 60 days.
Need your suggestions.

This is R.Ramkumar, I was work with HCL comnet for 10 months but i quit my job without inform to my HR and without provide any notice period as well.almost 5 months completed... now am searching job, so i required reliving letter from HCL comnet is this possiable to get reliving letter from hcl. 60 days is my notice period with HCL.
I have 4 months Experience,if i left that 10 months gap in my career,Is this possiable to get job in MNCs..

Companies have the right to repudiate the relieving letter if the N.P. was not served and charges not handed over. Pon

For getting your relieving letter, sure you must serve your notice period, otherwise you need to buy it......
Notice period must be served as per the term mentioned in your appointment letter.
If you conduct was too good and if the company worth your service, they can issue the letter without fulfilling the above two conditions..........
There is no other way............

As you left the job five months before without serving notice period,
The company will have wrong opinion on you. So you first call your Hr or go directly and meet them.........
Explain why you left the job without serving notice period, if you cant tell the truth then say same some other reason and try to earn sympathy of your Hr...........
If they didn't convinced by your reason , then tell them i will pay for it.......... Surely you will be getting it......
But make sure that you are in need of that letter or not....... Because unexpected issues may also arise........

HR themselves should understand and relieve the candidate immediately, they should not unnecessarily make unreasonable policies, 30 days as notice period is enough.

Here I would like to take your attention on Relieving Letter. I have resigned from my existing company and I am serving 30 days of notice period. As per my Offer Letter 3 months of Notice is applicable or salary for the equal amount need to deduct in F&F
After my resignation, my reporting boss pushing me to serve 60 days of Notice instead of 30 days. I have requested him at my best. I am agree on the deduction part but still he is pushing me to serve 60 days of notice. New employer does not allow me more than 30 days of time.
Could you please suggest me for happy and legal exit, process, method or action which I have to take during my 30 days of Notice so that I can save my new Job

Dear PK,
No, your boss can't force you to serve notice period when it is specifically mentioned in the appointment letter that in absence of notice period you have to pay notice pay. You can also request your existing employer to adjust all your pending leaves in your notice period or to make payment in case on no adjustment and request for a formal letter from him which says that you have to mandatorily serve notice period and if it doesn't work out please approch your HR for intervention. Hope they will surely help you and if they are also not agreeing then tell them you will approach labour court/authority for such harrassment.

This is Soanala. i have work experience of 5 months in overseas education consultancy as a career consultant. becasue of financial problems i was forced to pick up a job. when i got a offer letter from the company, i joined immediatly without any second thought. i joined in February 2013 and i even got two/three performance achievement awards certificates. but later i was not fine with the job timings and also i need to prepare for my Semester exams and also i need to go for the treatment for my health problem. so i had many issues to quit my job. so without informing to ANYONE in the office/company, i just left the job (simply stopped going). but now i applied for other jobs. i mentioned that i have 5 months of work experience. Now, i am worried how to get the releieving letter from the company i left to submit at the interview.

and now i really dont want to go to the office for asking/ requesting for my releiving letter. i feel awkward/odd/ bad. cause if i go back to the company and asks anything, i dont know how will they react. im just worried and embrassed. thats why im hesitating to go office and aks them. so please help me out, what to do in this case. pleaseeeeeee, suggest me what to do.
