Hi all :

I have recently joined the Organisation and head the HR.

We have a HR Executive whose qualifications is LLB and has provided a copy of the marks sheet from a northern University which is available in his personal file. He had joined the Organisation about 1.5 yrs than me.

In his correspondence both internal and external, I have never come across any legal word even by mistake.

Even for a simple letter directing an unauthorised employee to report back for duty immediately and offer a written explanation, his draft was bad which had to be corrected.

This leaves me with a great doubt - and hope I am wrong - whether he has really passed his LLB examination or not and whether the qualification certificate is a genuine one or not.

He being the HR Executive, and also having been in the Organisation earlier to me, I am not able to question him about the authenticity of the certificate which I am afraid will not be liked by the Management also.

Under such circumstances, pls help me as to how I can make sure that the educational qualifications of employees are genuine ones especially the one I had referred above of the HR Exec.

Hi, Please get the copy of the degree and send it to registrar for verification, they will return back by post with verification stamp. Regards Tareen

Dear Tareen :
Thks for the suggestion, but I feel that it will be time consuming and cannot be dealt in confidentiality.
Also, I wonder if the Registrar's offices will be able to comply to our request just be a correspondence from the Organisation with regard to the geneuninity of the certificates.

IT IS NOT NECESSARY THAT, IF U PASSED LLB THEN YOUR DRAFTING SHOULD BE VERY GOOD.. IT MAY BE POSSIBLE THAT AFTER DOING HIS LLB HE DIRECTLY JOINED THE CO. AND DIDN'T PRACTICE BUT U MENTIONED THAT IT WAS TOO BAD THEN IT IS A SERIOUS MATTER BECUZ A LLB & HAVING IN HR HE SHOULD BE WELL VERSED IN CORRESPONDENCE.. U CAN SEE HIS CERTIFICATE AND CAN VERIFY FROM THE COLLEGE...OR U CAN ASK HIM SOME LAW RELATED QUESTIONS WHICH IS COMMON FOR A LLB STUDENT.. AFTER ASKING U CAN MAKE AN IDEA...

Dear Dinakaran,
This is the only way u can get the genuinitity, college or university registrar can verify that the certificate is geniun, no matter how long it takes.
Issue a memorandum and inform the employees that from onward every documents will be verified by the department.
For future add one clue in the application form, mentioning that IF ANY INFORMATION FOUND FALSE, Services will be terminated with immediate effect.

Thks for ur comments.
The point I would like to make is, having passed LLB exam, in the correspondence, a bit scent of legal words has to be there - which is missing in our Person.
Also, matters relating to disciplinary actions, the involvement of him advising legal consequences is also missing.
Hence the question of verfication of the certificates has risen in my mind.
Shall look into the possibilities of contacting the registrar and shall keep all informed of the results, just for info.

I think it is right for you to chech the authenticity of the certificate. It is obligatory that the register certifies the certicficates from his or her
university.You can inform the registrar to treat the information confidential. Indeed verification of authenticity of certificates are normal HR procedure and you do not have anything to fear.
However you also appreciate that if the vertificate is fake then the employee would have contact to intercept any correspondence in respect of his certificate

If you see the posts made by many members in citehr, I have seen their posts of requests, for help etc.

Their english language is really horrible and the introduce themselves as HR Manager, Sr.HR Executive and so on.

So when a HR Manager, Sr.HR Executive that too in citehr, doesnt even know how to draft a request, then what the hell they are performing in their job.

AND YOU LIKE A POLICE DOUBTING THE INTEGRITY OF A HR EXECUTIVE < THAT TOO IN UR OWN ORGANISATION < WHO IS A YOUR COLLEAGUE,

im too hurt by this .... :-x:-x

You know there are many many students, pursuing courses in many many colleges, they work all year and duringexam times manage to study and pass, and may be after the exams are over they might not remember what they studied.

And drafting legal words, letters, comes from experience and not from just learning LLB.

In my organisation, I am in close relation with my Admn-Legal Head and our Advocate, so I interact with them closely and go through their letters, and whenever i draft any letter, then I remember their written correspondence and take reference from it, and add some legal words in my letter, if required.

What legal advice you expect from your person, if he is not trained / never done any legal job ,
then as HR why dont you train him, and assume that his LLB certificate is genuine.
But your thinking goes somewhere else, you are interested in checking his certificate and somehow terminate him.
HR should train and develop a person.
Look for aspects other than legal in your person, look for some qualities which are good in that person.
Dont take one point legal and proceed with terminating him.
And I think it is not ethical to verify certificates of old candidates, for new candidates u do verify.
But for already working candidates, it is not good in the interest of organisation and not recommended
