Dear All,
My problem is .. i have got selected in one company where i have been given offer intent with joining letter. i have been told to take relieving from previous company urgently where my notice period was of 3 months.
i managed to take relieving within 15 days as new company promised to pay penalty amount of notice pay. When i got relieved from prev company, due to uncertain resons my joining postponned ..so many times i contacted them every time meangless reasons are presented to me also told that i can start a new job search..
In this case what are the options for me?? what should be my stand about legal action OR compensation .... pleezzzzzz suggest me

Hai sailesh i could not understand your problem when the offer letter is given to you. then the joining date will also be there. You can directly go to the company and claim for joining

As you have mentioned that they promised to pay the compensation of the notice period then it should be written in the offer letter. iF it is not then its your fault..
If it is written then you can directly go to the company and meet the seniour HR and claim for the job with compensation. or els you ar very eligible to take a legal action as a offer letter is a wriiten agreement which should be bound to

Reference to your posting, you have mentioned that your joining had been postponed due to uncertain reasons. If you can clearly mention that you have requested for the postpone of joining or the company, it will be easy for us to help you.
In case, if you have postponed the DOJ then it is your fault if you have not requested or received the new offer letter with new DOJ as document. If you have postponed the joining then the company might have thought that you may not turn back and the company might have the urgency to close the positions.
If the company had postponed the DOJ you should have requested the same in writing
Mean to say who ever had postponed the DOJ you should have requested the new letter for future reference and further processes.
Please correct me if I have stated wrong

as they are telling me that i should start search for new job or wait for infinite time ( time they r not mentioning )..
can i take any legal action if they r telling me so..
as per as penalty amount, it was verbal commitment made by cmpny to me.. except that can i take legal action if they are not willing to join me??

1) company postponned my doj 2) they are not giving me in written the new doj ..as new doj is not fixed .. almost 1 month is over.. wt shud i do now??

I wish you had a very promising base to rely that you would either get the job or justification for what has been done.
What happens is - the HR should make the Employer / boss understand, even before sending an offer or appointment letter that the candidate would completely depend on the offer letter and quit his current job, hoping to join us for a better career future with us. The team should be very confident that they would definitely need a person for teh role they are hunting for. Sometime - management people change and recruitment plans also change - these situations can make things really worse for candidates being interviewed as activities may go on for a hold or completely freeze, or even decision of the management may change.
If they have mentioned that "You can start looking....", I guess, they meant that the chances of this position being open is really less (less that 10%) Take this as a lesson (harsh though), and start looking for a new job. Please present the offer details to your prospective employers interviewing you.
On the other hand I would suggest you to be try holding back your emotions and casually ask the HR or the co-ordinator there on what exactly is the situation - do they really need or not require a person there? Be open, and ask them to not worry even if its a negative response, becasue you will get to know what happened.

Hi,
I had gone through your previous post. The people who had given you the offer letter should be more careful. This is really shocking. Now the thing is this definitely u need to look forward.
Talk to these ppl as well directly to signing authority in the offer letter and the coordinator as well.

The company can stop the offer at any point of time of due to various reasons, It might be a back ground verification or the requirement at this position have been changed due to the financial crisis or might be some other reasons where the company can always save its skin from this kind of situation.
But I really feel bad what ever happened with u as the company had gambled with your career and life. Against this you might but I am not very sure to go against the company with legal actions, better to meet the lawyer in the labour court and ask for the proper solution.
