Hey All
Need your help.
One of our employee has gone onsite for one project. Now he has come back. During that period he worked on Saturday & Sunday and also few more holiday which is there in India but not in other coutry. Now that person has asked to give leave against those holidays.
Mine question is he right or wrong & secondly when you work onsite or suppose if few holidays are there in other country but not in India or vice-a-versa. How to treat those leave or holidays.

Usually when deputed to client location on the project the employee is required to follow the holiday calender, worktimings of the client but the leave policy of his company but leave sanction with the prior approval of the client manager.
Instead of giving compensatory off, for the Consultants working on client project at customer location if they have successfully completed the project with the time limits you can offer some kind of project bonus or 2-3 days paid-off if they are deputed to any out-station project which will boost up the morale of the employee.

Thanks a ton for your reply.
The employee is saying that whatever day he has worked at client side on saturday and sunday and other day, he wants paid leave for those days as he has come back now.

What I feel is that he can be provided with a paid leave if work is not effected and that the HR can decide to distribute his leave according to the company policy(number of days at a strech) and based on his performance for the project which will motivate him to work further for the upcomming projects.

These things have to be actually clarrified before deputation. You should include a clause which says that while on deputation rules / laws / policy of the nation/organisation will be effective. However if a few days compensatory off does not affect you, it could be given not to affect his motivation.

Leave rules,working on holidays are very important policies in an organisation.Your HR dept should sit with the project & operations people & plan a proper leave policy regd these things for future.In the present scenario if a person is on tour or deputation to a project site then local rules may apply to him or you may apply your company's existing rules to him.In case the person has worked religiously on holidays & delighted your client then as a progressive HR professional you should compensate his holiday leave.But for future scenarios decide now how you will take care of these issues.Probable suggestions are :-

a) The employee can encash these holidays at basic salary per day only.

b)The employee can avail C.Off in next prevailing 3-4 mths only.

c)The employee can accumulate these type of leaves of maximum upto 15-20 days in a year & at the end of the year they can be encashed at gross salary.These are just suggestions, you can think of other creative options also.

Hi, If any employee working on saturday or sunday or any holiday outside india but he is abide with the rule of company so he is entitled for paid leave
