Hi, Please confirm whether there is any law for part-time employee gratuity amounts.
This is regarding retail industry Employees. Part-time employee works 4 hours per day and gets a salary as per the minimum wages of Maharashtra.
Is the employee eligible for gratuity as per Full-time Basic Salary or 50% of the amount of full-time time?
Emp completed 5 years service.
Full time emp basic salary is 14880/-

Hi, Yes Gratuity applicable to part time employees provided they have completed 5 years of continuous service. Please ensure employer is covered under Gratuity Act.

I think your question was not clear
1. There is no distinction between full and part time employment in Gratuity Act. As long as they worked without a service break for 5 years, they will get Gratuity
2. Yes, they will get gratuity
3. Gratuity will be paid on their salary (last drawn salary) so it will be on basic and DA from the last pay check
They are not getting paid full 8 hours salary, They are getting lower salary for working for lesser hours. What would be the reason to take half of it off for gratuity? You will have to pay on their full wages
