Reply to your posting No act says that Basic should be this in the minimum wages BASIC +DA is defined as wage better to follow 50% safer on both ends,its completely depends on company policies,

In my concern we are following the below structure..it almost satisfied our labour law complieances (Minimum Wages) as well as PF enforcement...
Basic 60%
HRA 20%
Other Allowances 20%
Gross 100%

In-term relief given by supreme court Splitting of minimum wages is permissible ,no need pay EPF on minimum wage but daily workers no splitting we have to pay on day wages as per minimum wage Act.

Thanks for reply but if employee's salary is 6500 and according to your breakup basic will be 3900 which is less than minimum basic salary i.e 4563 so what will be there salary breakup.

In our company we a Salary structure i.e. 3000-300x5-4500-EB-450x5-6750-EB-675x5-10125, here 3000 is the basic which meets the minimum wages of the state of Orissa for unskilled worker.Salary break is calculated as :Basic. - 3000
HRA. - 600 (20% on basic)
Conv.- 300 (10% on basic)
Misc.Allowance. - 1100
----------------------------------------
Gross Salary . - 5000/-
This calculation was in previous company. but now in my present comapany, we are following the minimum wages as per the grade of worker whether he/she is coming under Unskilled or Semi Skilled or Skilled or Highly Skilled. Accordingly have to fix up the basic and rest of the salary is taken into allowance part which meets all statutory compliances.
It varies from co. to co.

Basic - 40% from gross
HRA - 50% from basic
Spl allowance-
Conv - 800(fixed we can put)
Gross - Total of this above 4(basic+HRA+SPL all+Conv)
Employer
ESI( Employer) - 4.75%(from gross)
EPF(Employer) - 13..6%(from basic)
Medical _ Dippance upon thecompany
Insurance _
CTC= call total of this above( gross + Employer contibution)
EMP'YEE SHARE/ DEDUCTIONS
Employee PF 12% on Basic
Employee ESI 1.75% on Gross
Professional Tax ( TN)
TOTAL DEDUCTION
Take home = CTC - Gross
