( Present Days :27 + Weekly Off : 04 = Total : 31 )
in this situation, if paid holiday given then days become 28 (Present 27 + Paid holiday 01 = Total : 28)
then it is compulsory to give Paid Holiday (26th Jan. ), Please Reply.

Dear Mr. Kailash
I wonder how paid Holiday falls on weekly off? Because Paid holidays are to be decided by the company except 2 National Holidays.
If you are referring to 26th Jan this year, it is simple that you substitute the Paid Holiday to other festival day so to maintain total number of PH in a year, to honour and comply, the National day to may declared as holiday even if it is regular weekly off.
If your company works 24X7 those in shifts and required to work on this PH day shall be given Compensatory off.

= As far as I know, there is no need for "to give extra days in a month as a Paid Holiday". It's nothing strange that paid holidays falls on Sundays/weekly holidays and you cannot shift them or change them. And you are paying your employees for a full month (28 or 29 or 30 or 31 days as the case may be) including for paid holidays & weekly off days. The question arises only when some of your employees such as "essential employees" are called upon to perform their duties on these days which will be treated as "holiday work" at par with OT who are called upon to work sacrificing a "paid holiday" and therefore entitled to additional remuneration as provided for in the acts.

It's true and correct not to substitute certain National Holidays. However in a Company where employees are required to work on rotational weekly off basis (7 days working), some employees may lose one or two days when the National or Festival Holidays Falls on their regular weekly off days. To compensate the loss of Holidays, it is advisable to pay them extra wages so that they will not be deprived of the Holidays, when other employees are benefitted.

Paid Holidays are of two kind i.e. National & festival holidays. The national holidays are being as it fall, may be in weekly holidays can not be substitued.
Whereas the Festival holidays are being decided by the employees's forum/Union which festivals to be declared for the year or the decission arrived.
Where employees are required to work on paid holidays the rules are clear they are to be paid as per the state/central rules under which the establishment is covered or obtained licence.

If a paid holiday like a National holiday or a festival holiday concides with a weekly off or a weekly holiday, it is not necessary to give extra wages or another compensatory holiday in lieu thereof.

Normally in 7 day working Company or continuous process Industries, weekly off will be on rotational basis. The worker whose regular weekly off on Saturdays and work for 27 days (all working days in January 2019 may not get Holiday wages for 26th January 2019. In many Industries, workers are paid on daily wage basis and the worker who had worked for all the 27 days should not be deprived of his eligible Holiday wages for no fault of him and has to be paid for 28 days in January 2019.
