Dear Sir,
I have a query related to gratuity. Are 240 days considered as working days or calendar days? In the case of working days, will the weekly off (Saturday, Sunday) be included or not?

Last Working Date: 13-08-2021
Please give your advice.

Dear Harish,
It would have been better if you had gone through Sec. 2-A of the PG Act, 1972, and analyzed it before raising the query. Continuous service for the purpose of gratuity, as defined under the above section, includes days actually worked, holidays of all sorts, authorized leave, unauthorized leave not declared as a break in service, legal strike, lockout, layoff, etc.
In the given case, the employee has completed a total service of 4 years, 10 months, and 10 days. Hence, he is eligible for gratuity as per the provisions of Sec. 2-A mentioned above.
