Hi, If an employee takes leave from 13th Aug 12 to 18th Aug 12 total no. of leaves is 8 days. In that 15th Aug 12 is Govt. holiday that day is LOP or paid holiday & mention rule also. Regards Sivaram

Hi, It should be treated as Paid Holiday if employee worked for more than 30 days in your organization...

For the purpose of working days.....It includes only working days of the Employees and it excludes any Festival holiday, Leave, without pay, any kind of absence from the work.
The holidays days are counted only for the purpose of continuity of the job of the employee.

Though leave rules differs from company to company, all holidays/ weekly off days coming in between the causal leaves are counted as holidays or weekly offs, as the case may be. Therefore, if 14th and 16th of August were CL, then only two CLs will be debited as availed and the holiday would be paid one. However, if the employee has been on Leaves without pay, Earned leaves or sick leaves then the holidays or weekly off days intervening shall be treated as leaves. That is, in the latter case, the holiday or weekly off coming in between two earned leave/ LOP/Sick leave will be counted as EL/LOP/SL. Continuing the same example, if he has taken leave without pay, the holiday will be without pay and if he has been on EL or SL then the holiday will be marked as EL or SL, as the case may be.

What does your Leave policies says. Go accordingly.
As per statutory compliance if any employee avails leave on both preceding & succeeding days then week ends and national holidays shall be treated as holiday.
Some organisations follows the same procedure and few due to welfare of employees will not consider as leave. Its left to the management.

Dear Sivaram,
1. Leave from 13th to 18th means total 6 days
2. If any staff take leave between holiday like 13th to 18th than 15th also considered as leave, whether its National holiday or weekly off or festival holiday.

Hi Sivaram,
As already mentioned it depends on your company leave policy. Most of the companies consider the total number of days he is absent from work as leave, but there are some companies, I am aware of a Japanese company where they consider only the working days eg if a person has taken leave on Friday and Monday then only 2 days are counted as Saturday and Sunday are not taken into consideration, because they are working for 5 days and all the Saturday and Sundays are off.

Yes, Anita is right. Meanwhile please check on your company leave policy whether Suffix or Prefix is included or not. Depending on this you can decide number of days leave availed by Employee.
