Hi Team,

We are an Edtech and IT services company based in Mumbai. We have over 50 employees. Our workdays are 5 days a week. Previously, all employees were entitled to 24 CEL and 14 festival-paid leaves. However, the management has now reduced the CEL to 12 days and festival leaves to 10 days, with no provision for other types of leaves such as CL, SL, or PL.

I seek clarification on the company's leave policy. Please guide.

Dear member,

Provisions of the Bombay Shops and Establishment Act apply to your company. Please follow those provisions. The number of days of leave can be more than the provisions of the said act but not less.

As per your posting, it is understood that the company has changed the "service conditions." The change in service conditions amounts to a violation. You and affected employees are hereby advised to bring this to the notice of the labor department in your area and also seek advice from lawyers. Please check the Maharashtra Shops and Establishment Act.

CL / National & Festival Holiday provided by your employer is well within the Act.

There is no provision for sick leave as per the Maharashtra Shops and Establishment Act. However, earned leave (or PL) is applicable.
