Hello everyone,
I have a question to ask just like in maternity leave a women employe. Becomes eligible for maternity benefits if she has worked for 80 days in organization, is there any such time criteria for paternity leave. Can a male employee avail it while being in training period i.equivalent not being confirmed??

THE ALL INDIA SERVICES (LEAVE) RULES, 1955
18(B) Paternity leave—(1) A male member of the Service (including a probationer) with less than two surviving children, may be granted paternity leave by an authority competent to grant leave for a period of 15 days, during the confinement of his wife for childbirth, i.e. up to 15 days before, or up to six months from the date of delivery of the child.
(2) During such period of 15 days, he shall be paid leave salary equal to the pay drawn immediately before proceeding on leave.
(3) The paternity leave may be combined with leave of any other kind.
(4) The paternity leave shall not be debited against the leave account.
(5) If paternity leave is not availed of within the period specified in sub rule (1), such leave shall be treated as lapsed.
Note:- The paternity leave shall not normally be refused under any circumstances.

Hii Dipti,
thanks for the information but my doubt was whether an employee being in training period can avail this leave or not. Is there any criteria for min. number days which he has to serve to the employer or whether he ha to be confirmed (regularized) in the organization.

Hi,
There is no such rule for paternity leave. I believe it totally depends on company internal policy.
In most of the organizations, it is normally allowed for 7 days and no confirmation / training completion clause is added. Applicable from the 1st day of service.
Pls let me know in case you have any different opinion.

Can you tell me which act these rules come under ? You can not take things in abstract There has to be a proper check to see if a certain set of rules do apply to you or to the concerned case

I AM TALKING ABOUT RULE NEITHER APPLICABILITY NOR CONFIRMATION because i do not have any idea regarding organisation (IS IT GOVT,PUBLIC OR PRIVATE SECTOR ???) .... BUT YES WHAT I HAVE POSTED Just for reference & knowledge and THAT COMES UNDER THE ALL INDIA SERVICES ACT, 1951 [No. LXI OF 1951]An Act to Regulate the Recruitment, and the conditions of services of persons appointed to the All India Services common to the Union and the States. Be it enacted by Parliament.

In exercise of the powers conferred by sub section (1) of section 3 of the All India Services Act, 1951 (LXI of 1951), the Central Government after consultation with the Governments of the States concerned.
