An employee has been suspended on account of criminal proceedings against him. Upon completion of the inquiry, the employee was acquitted of the charges. However, in the departmental inquiry, the charges were established, and a punishment order of reduction of basic pay was issued. The period of suspension was treated as a period spent on duty.

In such a case, the following allowances, which are based on the actual attendance of the employee, are payable or not:

1. Transport/Conveyance Allowance
2. Canteen Subsidy

Punishment Order from the Employer shall come into effect, not retrospectively but from the date of the said order.

As far as allowances and canteen subsidy are concerned, they have to be in accordance with the provisions of service rules or certified standing orders, as the case may be, i.e., fair, proper, and just.
