hi
I have one query related to continues leaves. Suppose a person is going on leave from 13 Aug to 17th Aug and 15th Aug comes on Saturday as its a national holiday and 16th Its Sunday.
So should i deduct his all days salaries or i will pay him for national holiday. that 15th Aug will not be counted in Leaves.
As per my knowledge that will be deducted but i want comments on this. May be i am wrong.

Hello Simran,
To the extent I know, if the person has applied Casual Leave [CL], then the intervening holidays [be they national or festival or sundays] WON'T be counted as 'leave'.
If however the person applies Earned Leave [EL] or Privileged Leave [the term some companies use] or ANY OTHER FORM OF LEAVE, then ALL the intervening holidays will count as leave.

Dear Simran Mandla,
There are differenced on this point. According to Shops and establishments act and Factories act, if the leave starts or ends on a holiday or a closed day, such leaves are excluded (in many states.). With regard to intervening holidays and closed days, however there are differences. The factories act includes such holiday or closed day in the leave.
{Mr.Srivastava, can you please elaborate the above statement}

Dear Simran,
We can apply one or two days as Casual leave. Suppose, it is more than that means,that will be Earned leave only.
And in this case, we need to know that, wheather he had reported back to work on 17th or not ?
if he reported back to work on that particular day means that will be a holiday for him.

Hi Simran, You will have to pay him for 15th August as its a National holiday. You cannot deduct his salary of that day. Nisha

To summarise, in this case August 15, since employee has taken leave preceding and succeding days, this will be treated as leave.
And let me clarify since this time independance day fall on Sunday whether we need to pay for that day...?
