Could you please guide me on whether standing order applicability depends only on permanent employees/on roll? The act applies to all shops and establishments in Haryana state, provided that they have employed 50 or more workers in the past 12 months. Do the 50 employees only include on-roll employees or do contractual employees count as well?

For coverage of the Act, whether it is the ESI Act, EPF & MP Act, Maternity Benefits Act, or the Standing Order Act, all employees, whether on direct rolls or through contractors, will be considered. Therefore, if the threshold limit is 50 for coverage under the Industrial Employment (Standing Orders) Act, it shall include contract workers as well. However, the provisions relating to service conditions will apply only to the workers on direct rolls.
