Dear All,
Posting here one query, pls check and provide confirmed replies.
We have terminated one employee with a proper one month notice. We are very ethically interested in paying all the salary also. But the problem is that candidate is living and working out of our State Rajasthan, as the candidate was working from home. And now the candidate is asking travel ticket or travel expenses to come to our office for full and final settlement, which will include handing over of all the company properties, signing exit formalites and releasing of all her dues or salary.
So, now pls guide me do we need to pay travel expenses to that terminated candidate ?? as now she is not working for us and indeed she is coming to get her salary.
Pls guide considering all the labour laws and state laws.

Prepare full & final settlement and send it to the residential address of the employee as an advance stamped receipt along with photocopy of cheque which you are offering as full & final settlement on 1 rupee revenue stamp.
On receipt of the stamped receipt you may deposit the cheque into the bank account of the terminated employee are send the settlement cheque to the residential address.
You may prepare receipt as under or whatever way you like.
RECEIPT
Received the sum of Rs.XXXX/- (Rupees:XXXXXXX) from M/s.______ address__________by cheque no._______ dated_____drawn of Bank name & branch in my favour towards full & final settlement of my account. In view of this settlement, I hereby confirm that I have no further claim of whatsoever nature against the Company including or reinstatement

Signature on revenue stamp (If the amount is >Rs.5000) This part is for payment purpose for which you need not pay any travelling expenses.

As regards to handing over charge and or submitting company documents, records etc. you need to send your representative to the employee's residence to collect the same, if you do not wish to provide travelling expense. Since this is termination case, employee will definitely insist for the same, why he will spend money to handover your documents which are in his possession. Decision is yours.

you may send the Full and final statement through mail in his personal mail id and payment may be sent through NEFt or bank transfer. you can do one more thing first send him F&F statement through mail on his mail id and take acknowledgement revert through his mail by accepting the said statement then you can deposit the F & f amount on his account by cheque or by NEFT.

In my opinion, even if the employee is terminated, he has to hand over company property before the FFS is made. In such a case he has to spend for his onward & return travel.
On the other hand if you feel that the property & documents are very important & has be retrieved you may opt to reimburse his travel expenses.
If his FFS is higher than the property owned by him he'll come by spending himself.

You can send F&F with cheque through registered AD and put acknowledgement (Postcard revert back from employee) as proof and bank credit statement too.

You write that she was working in another state, out of Rajasthan. Why not mail her all the F&F details and request her to attend at your place on predefined time; requiring her to take with self all the belongings of company handed over to her from time to time.
In my opinion, organization should be generous enough to pay to and fro traveling expenses to her since she is to travel from another state, particularly considering that she is a woman employee. This gesture, apart from setting a professional practice; can fasten sense of belongingness between employees and management.
