I am writing on this forum relating to Termination of employment.
I was working with a private MNC as a workmen in Bangalore for close to 7 months.
I had joined the company on Apr 2015 and was under probation for 6 months.However they have not confirmed on my probation since I had resigned.
During our joining a consent was taken from the employee's for 'Training bond' however there was no mention of Training bond and its clauses mentioned in the offer letter.
During my 6th month of probation I had an offer from another MNC for a better role and package based on which I had sent a resignation mail on 19OCT2015 to my manager.
2 weeks post my resignation the HR is asking me to sign the bond forcefully or pay bond amount of 2.5 lacs which was never discussed during our joining and failing to which they told the exit will not be smooth and will not provide any service letter or relieving letters and would be terminated.
There is 2 months of notice period mentioned in the offer letter.
There was discussion ongoing with the HR and management on training bond since I had already resigned and I was under my notice period and had already served 1 month and 6 days and when I sent a reminder mail to my manager to confirm on my Last working day on 25 NOV2015 there was a exit meeting arranged with the Sr.HR and my Manager where in I was being forced to sign the bond since I did not agree to sign as I had already resigned from my job I was told that you will be terminated with immediate effect and was told to handed over the company belongings and documents and was told a Termination letter will be sent as a hard copy to mailing address along with full and final settlement.
It has been over a month and I have not received any communication regarding my relieving or termination due to which my joining with other company is getting delayed since I don't have any confirmation on my relieving.
Can you please advice or suggest the legal action to be taken since this is affecting my career.

Is the new MNC aware of these problems?
Are they ready to take you without old company documents?
The point here is legal remedies will be long drawn and will not be effective within time frames your new MNC is ready to wait.
i would suggest that you speak to your new employer and explain the matters to them.
It is a tough call,because your old company is rigidly holding on to its position.

I have informed about my current situation to the new MNC and they have extended my joining till 1 st week of Jan 2016.
They insist that acceptance of resignation or relieving letter is required for joining.
I am following up with my previous company manager and Sr HR but have not received any response.
