Hello All,

I have a query , if one of my employee takes leave on Saturday & then rejoins office in second half of Monday. Does Sandwich Law apply on him?
( Note : Our company applies sandwich law if employee remains absent on Saturday & Monday )

In my company, Sandwich Law is also applied, but as an easygoing boss, in a case like the guy in your company, it will still apply. How about your company? diggy

The basic premise is that for the sandwich rule to apply the employee has to be working either on the preceding or on the succeeding day, that is from the end of previous day or to the beginning of the new day. Otherwise, it will be affecting attendance and dilution of availability which would affect the organisation adveresely.

Hi, As the employee reported back second half of Monday Sandwich leave policy should not be applied in his case.

Since the employee remained on leave during the first half of Monday, Sunday will be lost to him as leave. But under normal circumstances, the CL will not be counted for sandwiching and if he has taken half day CL then he can get the benefit of sandwiching holiday.

In Your case as the employee reported back in second half of Monday then Sandwich leave should be considered!!!

Further... Sandwich policy holds no Legal Provision and Restrictions, it can be followed by any company/employer as per terms discussed with the employees or as per companies Standing Order/Leave policy. And this can also vary Company to Company.

Hi,
There is no such Legal Provision and Restrictions related to Sandwich Policy. This policy is being followed by companies according to their standing order or leave policy only & it varies from Company to Company.
So from my view point it applies only when one remains on leave on Saturday as well as on Monday.
