Hi,
We are in process of preparing Holiday list for the year 2016. There are 3 working days where holidays fall on sunday.
I need to know can we give alternate day off as per Policy? for ex-: 1st May Labour day & 2nd Oct fall on sunday.

If an usual national holiday falls on Sunday, you have to provide any alternative holiday which was published by the govt in its Gazette. There should be minimum of 9 days of national holidays and festival holidays to be declared every year by every establishment.
If a 1st May falls on sunday, you don't need to show that in form V. Show other holiday instead of this may day.

Dear Stephen,
Pl clarify 9 National Holidays I think there are 4 only .
Holidays following on Sunday or Weekly Off to be discussed & Mutually agreed by Man agent 7 Employees
Team .
You have to mention in circular that since these days are following on Weekly off / Sunday ,therefore this year only ALTERNATE OFF has be given for clarity .
Otherwise employee will ask next year also by which extra financial burden will follow on Management.Plus BAD PRACTICE .

Dear Priyanka,
There are only 4 notified National Holidays.
For better practice with management approval, u can fix a No. of Holidays (National+Festival).
If any National or Festival Holiday falls on Sunday. In that case you can include other Holiday in the list. By doing so, there will be fixed No. of Holidays every year. The Co. will have equal financial burden.
Our co. is providing 10 Holidays in a year (being 5 day working). If you have 6 day working, you can increase the No. with management due approval.
By doing so, the employee will never have unrest situation. They will be well prepared to get fix No. of Holidays in a year.

Hi,
Please refer to the judgement of The Tata Oil Mills Co. Ltd vs K.V. Gopalan And Ors on 15 April, 1965 by supreme court of India, which says that the total number of paid holidays should not be less than the total numbers specified in the act.. In TN NHFH act, it should be not less than 9. If the national holiday falls on weekly off, you are supposed to pay extra pay excluding the weekly off wage.
So to make sure that the total number of holidays should be as per the provisions of the said act, the companies are practicing to provide the alternate days as holidays in Form V.
