I want to know that have you earlier told/ cautioned him about his poor performance or first time itself you want to terminate. I suggest instead of termination better to inform him about his poor performance and the management's decision of termination and ask him to submit resignation so that he can get the clear service certificate.
Next time onwards build up the file, you may have to face some critical people who may challenge the decision of the mangement and ultimately you have to face the music.
The process need to be followed is to evaluate the performance on quaterly basis, communicate, obtain the signature on the appraisal sheet, prepare performance improvement plan if he is a low performer, evaluate on monthly basis, even after that the employee is not meeting the required levels then ask the employee to submit the resignation, if the employee fails to submit then terminate.
