If they are showing any such deduction, it is wrong and not sustainable in court of law.

Legally an employer can not hold on to an employee beyond the Notice Period. There is no law specifying this and one need to understnd the Contract Act.
Only exception is if there is a disciplinary action on an employee, then the Management can refuse to relieve the employee till the proceedings are over. Again, the employer need to take all measures to complete the process fast and any undue delay will be against the principles of natural justice.
On unfinished assignment. legally an employer can not hold on to the employee.

im Ameer from chennai.. i was working in MNC company Jan 2006 to July 2011 more than 5 years and 4 months,then i left that company, after 1 year only i came to know every company has to pay the Gratuity Amount if the employe completed 5 years. i called my HR i ask about Gratuity they said. if u want Gratuity amount means your suppose to work for 7 years then only u will be qualified for the Gratuity amount this is what they told me. .im totally confused with this plzz help me.. will i get my gratuity amount ..

Some companies do not take the training period for calculation, If they have issuesd a letter for training for two years and called it as stipend and given you training and maintained records for the same, then you may not get gratuity. Your terms for the first two years and nature of work will have to be examined.
