My friend works in a mid sized organization 1200+ employee.
He got other offer and wants to resign but he is scared if higher management dont accept resign and force hime to work then what he should do??
(In appointment letter it was mentioned that u have to serve 2 months notice period or 2 months salary in lieu of)
Please suggest.

They cannot say that they cannot relieve you, when you comply with the company rules.
1. Firstly request them to reduce the notice period, if applies ??
2. Secondly, if not - check out, whether you have a option to buy back your notice period, i mean - pay money and reduce your notice period.
3. If Not ..?? the only way is to abide by the norms, mentioned in your appointment letter - Give two months notice and collect your relieving letter and service certificate and leave the organization.

If any employee abscond from the organization with out proper notice:
-the company has right to stop his salary payment and other allowances due.
-company will not provide the reliving and experience letter.
-The employee is blacklisted from that company.

Please refer terms of appointment. In the appointment letter you can see a clause on 'notice period pay'. Accordingly you may resign from service. If One month notice-you give resignation letter to the management or your immediate reporting authority, one month before the date you want to leave the present organisation. If nothing has been mentioned in the terms of appointment, you can jolly well give the resignation letter and leave the organisation from the next day.
If the management refuses to receive your resignation letter, you please send the resignation letter by Registered Post with Acknowledgement due to the person who is looking after the affairs of the company with a clear note that ' since this letter has been refused to receive by my superior, the same has been sent to you for necessary action'
