In my organisation, when they approve for maternity leave, the managment is telling to automatically deduct the CL and EL in the concerned employee account, which falls in the Maternity leave period of that employee.
Is it Right, please guide me as how to advice managment in this regard

Hi Sankar ,
As per me, we can't deduct the employee leaves to avail the maternity leave . I think your management wants to get some benefit from this..
So try to convince your management that it may give some legal problems to the company.

Dear Sankar this is not right and as per maternity benefits act Such employees are entitled to get 12 weeks leave only on fixed pay. and even law says that if employees wants they can request for light work (if they are employed to conduct some heavy kind of work like weight lifting and all) for 10 weeks prior to delivery.
and say your management that its a statutory compliance and if not follow or employee complaints than there is 6 months imprisonment provision alongwith Cash fine as per law
