I am working in a private sector. I had completed 4 years 6 months, after 6 months am going to take maternity leave. May I eligible for gratuity.Kindly advise,How can they calculate gratuity.

You will get gratuity when you leave the job or retire from the job. If you are proceeding on Maternity leave and will re-join after the leave, there is no question of Gratuity being calculated.

In any case, if you go on leave after 6 months, you would have completed 5 years of service. Thus, you will be eligible for Gratuity if you do not plan to return to the job after the maternity leave.

You are eligible for gratuity if you left the job. Gratuity calculation if you left the company: Basic+DA/26*15*No. of years you worked. You have to work more than 4 years and 6 months to achieve gratuity. It will be treated as 5 years.
