Dear All,
Their was a case in 1987 with Siemens V/s Employees, were in the supreme court of India has passed on a judgment that PF is not applicable to Construction Companies. Were in I have talked to many Labor Inspectors, Labor Commissioners, PF Inspectors & PF Commissioners, they all say that PF is applicable to Construction Company.
I am searching for the notification/ superseding orders of Supreme Court in this regard.
Can anyone help me in this.

As far as I know there is no such exemption available to construction companies with respect to Provident Fund. Till recently employees at construction sites were excluded from ESI but now they have also been brought under ESI coverage.

Dear All, As per my knowledge, PF is only exempted in case of Jamu & Kashmir only. Other than that in each of the states are covers. Where 19 or more employees employed, the PF acts is applicable.

I completely agree with Mr.D.N.Sharma. Due to the nature of industry which is time bound and also huge labour turnover, I am doubtful of availing the benefits more particularly under EPS by most of the Labourers working in construction Industry. Infact , in this forum, I too have sought for copy of the notification applicability of PF to Construction Industry. Though as expressed by many participants it is mandatory to cover the construction industry, considering the practical difficulties I feel the representatives of the Industry should take up matter with the Appropriate Authority.
