I have worked with the BPO company located in Bangalore. The company had a notice period of 2 months. I had to resign for my job due to a Death in Family and had to move to native asap. However, I still gave one full month notice and couldn't give the rest 1 month due to tensions at home. I was not left with any other option than leaving the company. My immediate manager kept telling me the policy but never tried to workout on the alternate.
Here is what I did,....Had to leave but not without the notice....
1) My immediate manager knew my date of leaving, which I requested to relieve me 30 Aug 2013 instead 30 Sept 2013. It was just one difference.
2) I have sent out goodbye email to all.
3) I have submitted my ID at the security, returned all office documents and keys to drawers as per process.
4) My team gave me a farewell on the terrace too, got pictures of it.
5) My Immediate manager ran away at 8pm that day as he knew that was my last working day as per my request.
Still they have marked me as absconding. Now, I have settled issues at home and back in Bangalore. I have been contacting my employer to either take me back into the job or let me the pay the one month notice to get relieving letter or to let me work for one month to complete notice period. AVP level HR says, there is no option....
I still feel that there should be some option when an employee is coming and asking for it. Can a company strictly avoid these 3 options? if they were at loss, I am ready to pay that one month notice to get relieving. I worked as an Assistant Manger and its hard for me to get AM post again without relieving letter.
Would like to take suggestions from all experts here before I go legal on the company.

Hi,
1. first thing you breached the policy, they will prove the same legally.
2. as you told valid reason someone dead in home so they have to accept it as humanity concern.
3. this problem can be solve with mutual understanding, so try to convince them.
4. there is no law for this to proceed legally.
5. they cant hold your full and final settlement and your relieving letters and all.
6. last option to you concern labor commissioner.
