My friend joined an MNC & was sent abroad for training after signing a bond.On his return he submited his expence bills ,as he got better job in another co he resigned. He also paid bond money and notice pay and co accepted his resignation.Now co is not giving relieving letter,when contacted HR says there is some problem with his expence bills. informal sorces point that co is planning to issue termination letter. Can a co do so? Once they have accepted bond money as well as notice money ,accepted resignation,given farewell party etc. More over so he has been given no chance to explain his case. If co does so what remedy lies with my fr pl give ans.

Here there is no problem in abroad training programme, got good job in another company, resigned, accepted his resignation.
There may be a policy in any office, that in case of any disciplinary casem pending against the employee, until unless it got cleared from such disciplinary case against the employee, he cannot be relieved eventhough he makes payment of notice pay and other Bond Amount whatever it may be.
Here the disciplinary case is (As I presumed from your wording), your friend has claimed excessively which he has been caught by the auditing team. So, as per the instructions of Auditing team HR might have initiated disciplinary action for making falsified claim for his abroad training programme, which is to be faced by your friend.
But will the falsified claim will attract the punishment of termination is only in question.
Here if it is proved that he continuously and repeatedly made false claim for times, then it can be, but for that also the HR has to provide the material evidence to your friend.
But in this case the previous employer can make the full recovery of his Travel expense Bill with some fine and interest as deemed fit and relieve him as resigned will be the correct way.
At least the company relieving will be benefitted from paying him the notice pay and other terminal benefits. If they terminate him then your friend must be paid with notice pay and other benefits.

I feel that you have really allowed your fertile imagination to take you onto a wild trip and you have drawn several baseless inferences and have offerred corresponding suggestions that seem to be quite out of place.
Do you not think that instead of creating your own inferences, it would have been more appropriate for you to ask for more information and details before arriving at any conclusion.
You have already decided that the concerned emplyee has repeatedy made falsified claims and will have to fact the music for his mis-adventures.

Your friend should first and foremost try to find out what is the exact reason for the delay in clearing his final documents. As you have stated, the HR has informed there are some problems with the expense bills. Your friend must take the initiative and approach the HR to get whatever issues there are sorted out. It might simply be that he has forgotten to attach some bills or invoices.
Either way, he should not listen to "informal sources" and follow proper procedures to get his relieving letter. If however, the former employer refuses to issue the letter and instead terminates him, your friend can always pursue the matter legally. The only thing he would need is a copy of his resignation letter accepted and acknowledged by the HR of the previous company and receipt of the bond money payment that he has made.
The company cannot terminate him without due notice and giving him reasonable chance of presenting his side of the case. So ask you friend to take things positive and work with the HR of the previous company to get his name and documents cleared.

I have added an "If Clause" in the sentence for continuous, repeated and false claim for times and for that also HR as to provide material evidence before throwing him out.
that means here removing him from the roles is not at all correct is the implied meaning for the sentence. But the company cannot terminate anyone for making falsified travel claims.
Hope this will be clear to understand.
One more thing I would like to tell you that instead of raising repeated questions without giving some reply will also demotivate the members and the members will obviously restrain themselves from asking question. Hence I have posted my reply.

ans.[Dear first you should take a look on the company policy, and verification on his bill expenses first you have to be confirm, what you and company want or if he has been paid all money of notice and all, so no liability of the company on that employee, even you have given him farewell party so this is the proof with him that company is happy to relieve him so employee is in more sound position in place of company. And read the first principal of natural justice so go ahead to justify with him]
